1. Member States shall ensure that all non-Contracting Party fishing vessels allowed to enter one of their ports are inspected in accordance with Article 31(4) to (8). The non-Contracting Party fishing vessel shall not be allowed to land or tranship any fish until the inspection is completed. Each inspection shall be documented by the completion of an inspection report as provided for in Article 33. 2. Where the master of the non-Contracting Party fishing vessel has failed to fulfil any of the obligations laid down in Article 24, points (b) to (f), the vessel shall be presumed to have engaged in IUU activities. 3. The port Member State shall immediately transmit the information on the results of all inspections of non-Contracting Party fishing vessels conducted in its ports and concerning subsequent action to the NEAFC Secretariat with the Commission and EFCA in copy. |
