2. By way of derogation from paragraph 1, the carrying on board and use of such equipment is permitted provided that:
(a) the whole of the catch which may be lawfully retained on board is stored in a frozen state, the graded fish are frozen immediately after grading, processing and packing and no graded fish is returned to the sea except for by-products such as offal or heads, and the equipment is installed and located on the vessel in such a way as to ensure immediate freezing and not to allow the return of marine species to the sea;
(b) the grading equipment on board the vessel has been removed from a power source and sealed by competent authorities prior to the start of the fishing trip rendering the grading system unable to be used until the competent authorities remove the seals;
(c) the fishing vessel is equipped with remote electronic monitoring systems on board for the purpose of verifying compliance with the landing obligation; or (d) the fishing vessel has an observer on board with the purpose of monitoring compliance with the landing obligation.
