If a measure referred to in Article 42(4) is a type of measure which is required under Article 22 of Regulation (EC) No 765/2008 to be notified through the Community Rapid Information Exchange System, it shall not be necessary to make a separate notification under Article 42(4) of this Directive, provided that the following conditions are met: (a) the Community Rapid Information Exchange notification indicates that the notification of the measure is also required by this Directive; (b) the supporting evidence referred to in Article 42(5) is enclosed with the Community Rapid Information Exchange notification. |
