This Regulation does not apply to: (a) state-to-state transactions or state transfers; (b) Category A listed goods, provided that they are included in the Common Military List of the European Union , exported or re-exported from the customs territory of the Union, unless they are temporarily exported or re-exported in accordance with Article 22 of this Regulation; (c) Category B listed goods, provided that they are included in the Common Military List of the European Union, exported or re-exported from the territory of the Union and destined for the armed forces, the police or the public authorities; (d) Category A, B and C listed goods destined for the armed forces, the police, or the public authorities of the Member States; (e) antique firearms as defined in accordance with national legislation, provided that antique firearms do not include firearms manufactured after 1899. |
