1. Europol shall ensure that the Data Protection Officer is involved, properly and in a timely manner, in all issues which relate to the protection of personal data. 2. Europol shall support the Data Protection Officer in performing the tasks referred to in Article 41b by providing the resources and staff necessary to carry out those tasks and by providing access to personal data and processing operations, and to maintain his or her expert knowledge.
In order to support the Data Protection Officer in carrying out his or her tasks, a member of staff of Europol may be designated as assistant Data Protection Officer. 3. Europol shall ensure that the Data Protection Officer acts independently and does not receive any instructions regarding the carrying out of his or her tasks.
The Data Protection Officer shall report directly to the Management Board. 4. Data subjects may contact the Data Protection Officer with regard to all issues related to processing of their personal data and to the exercise of their rights under this Regulation and under Regulation (EU) 2018/1725. |
Regulation (EU) 2016/794 of the European Parliament and of the Council of 11 May 2016 on the European Union Agency for Law Enforcement Cooperation (Europol) and replacing and repealing Council Decisions 2009/371/JHA, 2009/934/JHA, 2009/935/JHA, 2009/936/JHA and 2009/968/JHA article 41a CELEX: 02016R0794-20220628 No one shall suffer prejudice on account of a matter brought to the attention of the Data Protection Officer alleging that a breach of this Regulation or Regulation (EU) 2018/1725 has taken place. 5. The Management Board shall adopt implementing rules concerning the Data Protection Officer. Those implementing rules shall in particular concern the selection procedure for the position of the Data Protection Officer, his or her dismissal, tasks, duties and powers, and safeguards for his or her independence. 6. The Data Protection Officer and his or her staff shall be bound by the obligation of confidentiality in accordance with Article 67(1). 7. The Data Protection Officer shall be appointed for a term of four years and shall be eligible for reappointment. 8. The Data Protection Officer shall be dismissed from his or her post by the Management Board if he or she no longer fulfils the conditions required for the performance of his or her duties and only with the consent of the EDPS. 9. The Data Protection Officer and the assistant Data Protection Officer shall be registered with the EDPS by the Management Board. |
