Member States may entrust the social partners with the implementation of this Directive in accordance with national law and/or practice with regard to the role of the social partners, provided that Member States take all the necessary steps to ensure that the results sought by this Directive are guaranteed at all times. The implementation tasks entrusted to the social partners may include: (a) the development of analytical tools or methodologies as referred to in Article 4(2); (b) financial penalties equivalent to fines, provided that they are effective, proportionate and dissuasive. |
