Requested Central Authorities shall, acting directly or through courts, competent authorities or other bodies, take all appropriate steps to: (a) provide assistance, in accordance with national law and procedure, in discovering the whereabouts of a child where it appears that the child may be present within the territory of the requested Member State and that information is necessary for carrying out an application or request under this Regulation; (b) collect and exchange information relevant in procedures in matters of parental responsibility under Article 80; (c) provide information and assistance to holders of parental responsibility seeking the recognition and enforcement of decisions in the territory of the requested Central Authority, in particular concerning rights of access and the return of the child, including, where necessary, information about how to obtain legal aid; (d) facilitate communication between courts, competent authorities and other bodies involved, in particular for the application of Article 81; |
Council Regulation (EU) 2019/1111 of 25 June 2019 on jurisdiction, the recognition and enforcement of decisions in matrimonial matters and the matters of parental responsibility, and on international child abduction (recast) article 79 CELEX: 32019R1111 (e) facilitate communication between courts, where necessary, in particular for the application of Articles 12, 13, 15 and 20; (f) provide such information and assistance as is needed by courts and competent authorities to apply Article 82; and
(g) facilitate agreement between holders of parental responsibility through mediation or other means of alternative dispute resolution, and facilitate cross-border cooperation to this end. |
