Presumption of IUU fishing A non-Contracting Party vessel shall be presumed to have undermined the effectiveness of this Regulation, and to have engaged in IUU fishing, if it has been:

(a) sighted or identified by other means as engaged in fishing activities in the Regulatory Area;

(b) involved in transhipment with another non-Contracting Party vessel sighted or identified as engaged in fishing activities inside or outside the Regulatory Area; and/or (c) included in the IUU list of the Commission for the Conservation of Antarctic Marine Living Resources (), the Commission for the Conservation of Southern Bluefin Tuna (), the Inter-American Tropical Tuna Commission (), the International Commission for the Conservation of Atlantic Tunas (), the Indian Ocean Tuna Commission (), the General Fisheries Commission for the Mediterranean (), the North East Atlantic Fisheries Commission (), the North Pacific Fisheries Commission (), the South East Atlantic Fisheries Organisation (), the Southern Indian Ocean Fisheries Agreement (), the South Pacific Regional Fisheries Management Organisation () or the Western and Central Pacific Fisheries Commission ().
