1. Information requested from the entities referred to in Article 144(2), point (d), shall be transmitted to the Commission in accordance with Article 36(8) and sector-specific rules. 2. Without prejudice to Article 138(2), second subparagraph, use of the data received through the Irregularity Management System shall take into consideration the status of the national procedure that existed at the time when the information was submitted. Such use shall be preceded by a consultation of the Member State that has submitted the relevant data through the Irregularity Management System. |
