1. This Regulation aims to facilitate and stimulate the roll-out of very high capacity networks (‘VHCNs’) by promoting the joint use of existing physical infrastructure and by enabling a more efficient deployment of new physical infrastructure so that such networks can be rolled out faster and at a lower cost. 2. If any provision of this Regulation conflicts with a provision of Directive 2002/77/EC, (EU) 2018/1972 or (EU) 2022/2555, the relevant provision of those Directives shall prevail. 3. This Regulation sets minimum requirements for achieving the aims set out in paragraph 1. Member States may maintain or introduce measures in conformity with Union law which are stricter or more detailed than those minimum requirements, where the measures serve to promote the joint use of existing physical infrastructure or enable a more efficient deployment of new physical infrastructure. |

By way of derogation from paragraph 3 of this Article, Member States shall not maintain or introduce the measures referred to in that paragraph in respect of Article 3(5), first subparagraph, points (a) to (e), Article 3(7) and (10), Article 4(7), Article 5(2), second subparagraph, Articles 5(5)and 6(2) and Article 10(7) and (8). 5. This Regulation is without prejudice to Member States’ responsibility for safeguarding national security and their power to safeguard other essential State functions, including ensuring the territorial integrity of the State and maintaining law and order. |
