Amendments to Regulation (EC) No 2679/98 Regulation (EC) No 2679/98 is amended as follows:
(1) Article 2 is replaced by the following: ‘Article 2 This Regulation shall not in any way affect the exercise of fundamental rights as recognised in the Member States and at Union level, including the right or freedom to strike or to take other action covered by the specific industrial relation systems in Member States, in accordance with national law or practice. It shall not affect the right of workers and employers, in accordance with national law or practice, to negotiate and conclude collective agreements and, in cases of conflicts of interest, to take collective action to defend their interests, including strike action.’ ;

(2) the following Article is added: ‘Article 5a 1. Where the internal market emergency mode defined in Article 3, point (3), of Regulation (EU) 2024/2747 of the European Parliament and of the Council has been activated in accordance with Article 18 of that Regulation, Articles 3, 4 and 5 of this Regulation shall cease to apply in respect to the crisis-relevant goods listed in an implementing act adopted pursuant to Article 18(4) of that Regulation for the duration of the internal market emergency mode.
2. Where paragraph 1 of this Article applies, obligations arising from this Regulation prior to the activation of the internal market emergency mode in accordance with Regulation (EU) 2024/2747 remain unaffected.
