Regulation (EU) 2022/2560 of the European Parliament and of the Council of 14 December 2022 on foreign subsidies distorting the internal market article 46 CELEX: 02022R2560-20221223 Guidelines
1. The Commission shall publish, at the latest on 13 January 2026, and shall regularly update thereafter, guidelines regarding: (a) the application of the criteria for determining the existence of a distortion according to Article 4(1); (b) the application of the balancing test in accordance with Article 6; (c) the application of its power to request the prior notification of any concentration according to Article 21(5) or foreign financial contributions received by an economic operator in a public procurement procedure according to Article 29(8), and (d) the assessment of a distortion in a public procurement procedure according to Article 27. 2. Before issuing the guidelines referred to in paragraph 1, the Commission shall conduct appropriate consultations with stakeholders and Member States. The guidelines shall be built on experience gained in the course of implementing and enforcing this Regulation. |
