1. Measures imposing anti-dumping duties and decisions to accept undertakings pursuant to Article 8 shall be subject to review, in whole or in part, where warranted.
Such review may be held either at the request of a Member State or on the initiative of the Commission. A review shall also be held at the request of an interested party who submits evidence of changed circumstances sufficient to warrant such review. Such requests shall be made to the Commission, which shall inform the interested Member States. 2. Where, after consultations of interested Member States, a review is found to be warranted, the proceedings may be reopened in accordance with Article 5 if the circumstances so require. The reopening of proceedings shall not, by itself, have any effect on measures already in operation. 3. In the light of the review, carried out with or without reopening proceedings, the recommendation, undertakings or anti-dumping duties shall, if necessary, be varied or withdrawn in such manner as the Commission shall determine after consulting the interested Member States. |
