1. Where the competent authority, after the examination of the application and the assessment of the outcome of the opposition procedure, including, where applicable, any agreed modifications to the application, finds that the requirements of this Regulation are met, it shall take a favourable decision without undue delay and submit the application, in accordance with Article 22(1), to the Office. Where the competent authority finds that the requirements of this Regulation are not met, it shall reject the application. 2. The competent authority shall make its decision publicly available. It shall publish electronically the product specification on which its favourable decision is based. 3. Any party having a legitimate interest shall have the right to lodge an appeal against the decision taken under paragraph 1. |
