1. This Regulation applies to the substances listed in Annexes I and II and to mixtures and substances that contain those substances. 2. This Regulation does not apply to: (a) articles as defined in point (3) of Article 3 of Regulation (EC) No 1907/2006; (b) pyrotechnic articles as defined in point (1) of Article 3 of Directive 2013/29/EU of the European Parliament and of the Council (); (c) pyrotechnic articles intended for non-commercial use in accordance with national law by the armed forces, law enforcement authorities or fire services; (d) pyrotechnic equipment falling within the scope of Directive 2014/90/EU of the European Parliament and of the Council (); (e) pyrotechnic articles intended for use in the aerospace industry; (f) percussion caps intended for toys; (g) medicinal products that have been legitimately made available to a member of the general public on the basis of a medical prescription in accordance with the applicable national law. |
