Directive (EU) 2024/1233 of the European Parliament and of the Council of 24 April 2024 on a single application procedure for a single permit for third-country nationals to reside and work in the territory of a Member State and on a common set of rights for third-country workers legally residing in a Member State (recast) article 14 CELEX: 32024L1233 Facilitation of complaints and legal redress
1. Member States shall ensure that there are effective mechanisms through which third-country workers may lodge complaints against their employers: (a) directly; (b) through third parties which have, in accordance with the criteria laid down by their national law, a legitimate interest in ensuring compliance with this Directive and the national provisions adopted pursuant to this Directive; and (c) through a competent authority of the Member State when provided for by national law. 2. Member States shall ensure that third parties referred to in paragraph 1, point (b), may engage either on behalf of or in support of a third-country worker, with the consent of that third-country worker, in any administrative or civil proceedings aimed at enforcing compliance with this Directive and the national provisions adopted pursuant to this Directive. |

Member States shall ensure that third-country workers have the same access as nationals of the Member State where they reside with regard to: (a) measures protecting against dismissal or other adverse treatment by the employer as a reaction to a complaint within the undertaking; (b) any legal proceedings aimed at enforcing compliance with this Directive and the national provisions adopted pursuant to this Directive. |
